These terms govern your use of pavingcapetown.co.za (the “site”) and any quote request or communication you send through it to Paving Cape Town (“we”, “us”, “our”). By using the site or requesting a quote you accept these terms. If you do not accept them, please do not use the site.
1. Purpose of the Site
The site publishes information about paving in Cape Town and lets you request a no-obligation quote. Paving Cape Town arranges your quote and the work that follows; the paving itself is carried out by independent paving installers — we do not carry out the work ourselves and we employ no pavers. The site is not a transactional platform: no paving service is sold or contracted through it. Any work you go ahead with is governed by a separate written quote and acceptance between you and the installer, to which we are not a party. This arrangement is set out in plain terms on our disclaimer page.
2. Quote Requests & Quote Disclaimer
Indicative prices, ranges or estimates mentioned anywhere on the site or in early correspondence are guidelines only. All firm quotes are subject to:
- An on-site inspection and measurement;
- Verification of access, site conditions, slope, drainage and existing sub-base;
- Confirmation of paver brand, product line and current supplier pricing;
- Any permits, body-corporate or HOA approvals required at your property.
Any quote becomes binding only once the installer has provided a written, signed quotation and you have confirmed acceptance with them in writing. Check the quotation itself for how long it stays open — that period is set by the installer who issued it.
3. Workmanship Warranty
Workmanship warranties are provided by the independent paving installer who carries out the work, not by Paving Cape Town. We do not provide, underwrite, guarantee or enforce any workmanship warranty, we are not a party to it, and we do not hold copies of warranty documents or insurance policies. The only warranty that binds anyone is the one written into the quotation you accept — read it before you sign, including what it excludes and how long it runs. We do not offer, set or promise any warranty period ourselves.
Warranty terms are set by each installer and vary. Read the quotation to see what yours covers; a paving workmanship warranty may exclude matters such as:
- Damage caused by vehicles exceeding the rated load of the paver class installed;
- Damage caused by tree roots, building movement, plumbing leaks or subsidence outside the installer's control;
- Cosmetic surface wear, efflorescence, or natural colour variation in clay, stone or concrete pavers;
- Work modified or repaired by a third party after the installer left site;
- Force majeure events including flooding, fire or earthquake.
To claim, contact the installer who carried out the work, in writing, as soon as you notice the defect — and check the notice period their own warranty sets. Tell us as well and we will try to help make contact, but we cannot compel an independent business to honour its warranty. None of this limits your rights under section 54 of the Consumer Protection Act, 68 of 2008, which entitles you to services performed in a manner and quality that persons are generally entitled to expect, and which sets no time limit of its own.
4. Material Warranties
Pavers, edging units, sealers and other manufactured products are covered, if at all, by whatever the manufacturer of that product offers, on that manufacturer’s own terms and through their own claim procedure. Ask which products are going into your job and check what the maker says about them before you sign. We are not the warrantor for any manufactured product and cannot process a claim on a manufacturer’s behalf, though we will point you to the right contact where we can.
5. Limitation of Liability
To the maximum extent permitted by South African law:
- We are not liable for any indirect, consequential, special or incidental damages arising out of or relating to our services or your use of this site, including but not limited to loss of profit, loss of use, loss of data, or business interruption.
- Our total aggregate liability to you is limited to the amount you have actually paid us. Requesting a quote through this site is free and we take no payment from you, so in almost every case that amount is nil. Money you pay an installer is paid to them, not to us, and is a matter between you and them.
- Nothing in these terms limits liability for death or personal injury caused by gross negligence, or for any liability that cannot lawfully be excluded under the Consumer Protection Act, 68 of 2008.
6. Images & Representative Examples
Images of paving styles, finishes and installations used in our page designs and blog articles are computer-generated illustrations, not photographs of past jobs. Final appearance will vary with the paver batch, lighting, joint width, edge restraints and site context, so confirm colours and finishes against a physical sample before you choose.
7. Use of the Site
You agree not to:
- Submit false or misleading information through any form on the site;
- Copy, scrape, mirror or republish content from the site without our written permission;
- Use the site in a way that interferes with its operation, security or availability;
- Submit content that infringes any third-party right or violates any law.
The text, layout, design and structure of the site are owned by us and protected by copyright. Any third-party material that appears on the site remains the property of its respective owner and is credited where it is used; we claim no ownership of it. You may view and print pages for personal, non-commercial reference only.
8. Third-Party Links & Widgets
The site may contain links to third-party websites — for example paver manufacturers, material suppliers and industry bodies. We are not responsible for the content, policies or practices of those third parties. Visiting them is at your own risk and subject to their own terms.
9. Privacy
How we handle personal information is described in our Privacy Policy, which forms part of these terms.
10. Changes to These Terms
We may update these terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the site after a change constitutes acceptance of the new terms.
11. Governing Law & Jurisdiction
These terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or relating to these terms or our services is subject to the exclusive jurisdiction of the courts of Cape Town, Western Cape.
